Partner Agency Agreement

1. Eligibility & Registration
To participate in the Agency Partnership Program, you must:
- Provide valid business registration (Shop Act/Udyam).
- Ensure all information provided during onboarding is accurate.
- Maintain a secure environment for processing client documents.
2. Service Fulfillment & Accuracy
The Agency is responsible for the accuracy of the data entered for the following services:
Identity & Govt.
Any rejection of Aadhaar, PAN, or Passport applications due to incorrect data entry by the Agency is the sole responsibility of the Partner.Financial & PF
PF Withdrawals and KYC updates must be initiated only with explicit consent from the account holder.3. Commission & Payment Terms
JobWorks operates a transparent, real-time earning model for all registered partners.
- Upfront Commission Model: Our portal operates on an instant-benefit basis. The partner commission is deducted at the source from the total service fee. The Agency only remits the net balance (Total Fee - Commission) to process the application.
- Instant Settlement: There is no waiting period or payout cycle. Your earnings are realized immediately upon transaction, as you retain your share before the final submission.
- Taxation & TDS: All service fees and commissions are subject to applicable government tax laws. Partners are responsible for reporting their upfront earnings in accordance with TDS mandates and GST regulations.
- Service Reversals: JobWorks reserves the right to recover or "bill back" commissions if an application is rejected or flagged by government authorities due to fraud, document forgery, or willful misinformation by the Agency.
4. Pricing Compliance & Fair Practice
To maintain the integrity of the JobWorks network, all partners must adhere to the following pricing and operational standards:
Service Fee & Extra Commissions
Agencies are permitted to charge a service fee/extra commission to the end customer for facilitation. However, this amount must be disclosed to the portal and must not exceed the maximum approved commission limit set for each specific service. Charging unauthorized or hidden fees beyond portal-approved brackets is strictly prohibited.
- Charging customers rates that exceed the "Approved Service Bracket" visible on your dashboard.
- Processing applications using fraudulent, altered, or forged documents.
- Sharing portal access or API credentials with unauthorized third-party sub-agents.
- Bypassing portal payment security to collect direct fees without system logging.
5. Limitation of Liability & Service Disclaimer
JobWorks provides a digital bridge between Agency Partners and Government/Financial institutions. Our liability is limited as follows:
External System Downtime
We are not liable for delays, failures, or data transmission errors caused by third-party government servers (e.g., UIDAI, Income Tax, EPFO, Aaple Sarkar). Technical outages at the source are beyond our operational control.
Application Rejections
JobWorks does not guarantee the approval of any certificate or license. Final authority rests solely with the respective government departments. We are not liable for financial losses arising from application rejections due to data errors or policy changes.
Force Majeure & Indirect Losses
In no event shall JobWorks be liable for any indirect, incidental, or consequential damages (including loss of business profits) arising out of the use or inability to use the portal. Our total liability is limited to the service fee paid for the specific transaction in question.
